New Delhi New Delhi, Sep The Delhi High Court has slapped a fine of Rs 50,000 on a businessman for filing a frivolous petition and delaying trial against him in a case of criminal breach of trust for allegedly removing the garments of his partner from their shop in a market almost two decades ago.
Dismissing a petition for quashing of charge framed by the trial court against M L Bhatia, Justice Mool Chand Garg in an order said "it is a frivolous petition and by filing this, the petitioner has delayed the trial for more than six years". Citing one ground or another, Bhatia moved petitions in various courts seeking quashing of the charge against him despite rejection of the petitions by the courts. "Once the petitioner had availed the remedy of revision not once but twice, he has no right to come to this court under the garb of terming their petition under section 482 Cr PC, which is the attempt made on behalf of the petitioner," the court said. Bhatia was accused of committing criminal breach of trust for allegedly removing the garments of his partner from a shop jointly run by them without intimating him in 1991.
