Delhi High Court has taken historical decision against 149 years old law, with legalising gaysex, India became the 127th country in the world to decriminalise homosexuality while 80 nations still consider it as an offence. The verdict was described as “progressive” by the Naza foundation and gayrights activists who fought an eight-year-long legal battle and evoked sharp reactions among religious leaders with Jama Masjid Imam Ahmed Bukhari and Father Dominic, spokesperson of Catholic Church, strongly disapproving the decision, saying homosexual acts were unnatural and cannot be legalized it is animal act only. ”Are we truly ready, mature, knowledgeable and responsible enough for big changes in our society and for cultural shock?”
Homosexuality has always been part of the Indian and world culture, even in Mahabharata it did exist, Shikhandi was acknowledged as trans- gender. Today, many trans-genders and gayhave gained popularity in fashion, film, music and dance industries and well respected as well. Till today homosexuality was treated as private issue, a bedroom privacy but after historical section 377, we are forced to think about out come of historical step taken by the Delhi court and making capital city Delhi also capital city ofgay now. A Royal Mughal King or Sultan was unthinkable without having a big harem. It was necessity to guard and keep an eye on activities of beautiful ladies of harem and queens as having so many queens, Kings were not spending enough time with all queens there were always fear of affairs and scandals. Male guards could not be trusted with beautiful ladies so there was big demand of eunuch at that time as guard of bedchambers and attendant.
Even many Sultan were GAyand had a passion for slaves possessing handsome faces and eunuchs because of the nature of their duties, they used to received sort of a special treatment Not only that but history says some of the greatest nobles in the Sultanate of Delhi and the Mughal Empire were eunuchs. Kafur Hazardinari, the army commander of Alauddin Khalji, and Khurau Shah the favorite of Qutbuddin Mubarak Khalji were all eunuchs. It is believed that it was also common in China, at the end of Ming dynasty; there were as many as 70,000 eunuchs and GAYSin the grand palace itself for royal quarters. Even today Like Prince of Rajpipla Manvendra Singh Gohil have publicly declared hisGAY status, even he was invited on the “Oprah Winfrey Show” in the United States, and at the same time his family had earlier disowned him publicly. He heads the Vadodara-based NGO “Lakshya”, which works on prevention of HIV/AIDS issue among gayand homosexuals.
There are different types in LBGT culture like LesbianGay, Bisexual, Trans-gender [eunuch] also. Time has come that we should understand these words seriously and get and give knowledge instead of giving opinions. We agree that today Eunuchs are treated as third gender of the society, lives in darkness, running away from the authorities who shoo them away. In many cases Trans-gender were harassed by authority in false crime also. We, the people look at them as dirt that makes the society filthy. They come and bless childbirth, weddings, housewarmings to get money .Everyday is a struggle for them .They also give sexual favor to earn living. Now Credit card companies have started sending them to recover money from defaulters and bad customers because the recovery rate is high as they use shame and embarrassment as tools. These all need to change as they should be treated as equal not as being on other side of society.
The violence that the eunuch community faces can be traced back to The Criminal Tribes Act of 1871 sub-titled ‘An Act for the Registration of Criminal Tribes and Eunuchs’. Under this law, the government was required to keep a register of all eunuchs who were reasonably suspected of kidnapping, castrating children or committing offences under Section 377 of the Indian Penal Code (IPC). The law also decreed eunuchs as incapable of acting as a guardian, drawing up a will or adopting a child. We can not also deny the fact that many crime, drugs, transmitting sexual diseases also connected with homosexuality.
Section 377 was the only law that was stopping growth of homosexuality in India. There will always be problems related to of HIV/AIDS among homosexuals andGays. There are other issues to be discussed as changing the law is not solution like mobility is a bigger problem in India. There are more than five lakh migrant laborers in Surat city only, living without a partner. In this case, homosexuality becomes solution with changing the law. After section 377 we will see many changes in society with time. Once if it becomes legal to have relationship between same genders, male to male and female to female it will also create many bad effect on our society as those were afraid of law will come out in open. There will be GAYparties, GAYbars, GAYmarriages, even they will be marketed, traded and will be tool of entertainment and making money. They will be new faces of million dollar industries, Drag kings and Drag queens, gayclothing, gayicons with media taking front seat and what will be the effect on young generation if we go on debating on about acceptance instead of addressing the real issues?
Though I agree that its personal choice and right for every human to choose partner and living life with equality and dignity. All are equal in eyes of law, but what about huge number of children are forced in to homosexuality due to poverty? Like Surat in many cities workers live without partners what about them? In hostels many turn in to homosexuality and lesbians what about them? In prison they also turn homosexual. These people are not choosing homosexuality but they are forced to choose that life.
Because of section 377 they all were reluctant till today but now time is changing, GAYand LESBIANmovements will be accepted so there will be huge growth in number of **** in society. From childhood and since from many generation we are taught and associate marriages and sex between man and woman is about communicating love so how we will change mind set ?We have to be aware that to protect dignity and freedom of sexual minority which is less than 1%, we cant jeopardize thinking of 99%of population also . Our culture is different than western culture; we still live as joint family with parents. When son gets married, he brings daughter-in-law at home. So are we ready to change that attitude that our son can get married to a man or our daughter can marry a girl and bring them home? Is our society ready for this change? Legal acceptance doesn’t mean social acceptance. Sexual education with awareness about human body, human psychology and anatomy , health based on science is now very important in India. When there is sex education considered as taboo in India, young children don’t get educated about natural sex, there is so much ignorance and myth about sex in society then how young generation will understand and react to unnatural sex and gayculture in our society?
